These Terms of Use and License govern the use of the WordPress software LinkYourShop and the related services provided by the manufacturer.

– hereinafter referred to as “Supplier” or “Manufacturer” –
The sale of usage licenses, payment processing, invoicing, and subscription management are handled by Freemius as an authorized reseller and Merchant of Record. Freemius may apply additional terms and conditions of sale and payment at the time of purchase.
§ 1 Scope of Application
- These Terms of Use and License apply to the use of the WordPress software LinkYourShop as well as to related services provided by the manufacturer, in particular the provision of software versions, updates, and support.
- Any terms and conditions of the customer that differ from these shall apply only if the manufacturer has expressly agreed to their validity in writing.
- A customer can be either a consumer or a business.
- A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial activities nor to their self-employed professional activities.
- A business operator is a natural person, a legal entity, or a partnership with legal capacity that, at the time the contract is concluded, is acting in the course of its commercial or self-employed professional activities.
§ 2 Contracting Parties and Conclusion of the Contract
- The description of LinkYourShop on the manufacturer's website is intended to provide information about the software and the available licensing models.
- Purchases of paid licenses are made through the ordering and payment system provided by Freemius.
- Freemius is the authorized reseller and merchant of record for the sales transaction. In particular, Freemius handles payment processing, invoicing, tax compliance, and the management of recurring payments.
- The prices, billing periods, renewal terms, payment methods, and cancellation options applicable to the purchase are displayed to the customer in the Freemius checkout before the order is completed.
- The manufacturer is responsible for the development and provision of LinkYourShop, as well as for the updates and support services required under these terms and conditions.
- The contract language for the manufacturer's services is German.
§ 3 Scope of the Software
- LinkYourShop is a WordPress plugin that allows you to import product data from an Etsy CSV file and display it as a product catalog on a WordPress website.
- The products featured in the catalog may be linked to external product pages, particularly Etsy listings.
- LinkYourShop is not a standalone online store system and, in particular, does not handle order processing, payment processing, shipping, or contract fulfillment between the website user and their customers.
- The manufacturer is not responsible for the availability, content, features, or changes to external platforms such as Etsy.
- Changes to interfaces, export formats, or the functionality of external services may result in the need to adjust certain LinkYourShop features or cause them to be temporarily unavailable.
§ 4 Technical Requirements
- To use LinkYourShop, the customer needs their own fully functional WordPress installation and the necessary permissions to install and activate plugins.
- The recommended or minimum required versions of WordPress, PHP, and the server are listed on the product website or in the documentation.
- The customer is responsible for ensuring that the technical requirements are met and for creating a proper backup of their website and data before installation or updating.
- We cannot guarantee full compatibility with all themes, plugins, hosting configurations, or custom-modified program code.
§ 5 License Models and Term
- LinkYourShop is currently available under the following licensing models:
- Trial License: 30-day use on one website.
- Starter License: Use on one website for the license period specified during the ordering process.
- Pro License: Use on up to three websites for the license period specified during the ordering process.
- The product and order description displayed at the time of purchase is decisive for the specific scope of services, the term, and the price.
- The number of permitted website activations depends on the license model purchased.
- A trial license may only be used within the scope intended. The manufacturer may take measures to prevent repeated or abusive trial registrations.
- If a license is offered as an automatically renewing subscription, the term, renewal, price, and cancellation options will be displayed during the Freemius ordering process.
- Automatic renewals can be managed or canceled through the customer portal provided by Freemius and the management features available there.
§ 6 Granting of Rights of Use
- For the duration and to the extent of the license, the customer is granted a simple, non-exclusive, and non-transferable right to install and use LinkYourShop on the permitted number of WordPress websites that belong to the customer or are lawfully managed by the customer.
- Use is permitted only within the scope of the purchased license model.
- The license may not be sold, rented, leased, sublicensed, or transferred to third parties independently of a permitted website activation.
- With a Pro license, use is permitted on up to three websites. Whether customer websites are included as part of a service depends on the license description provided at the time of purchase.
- The customer may make backup copies of the software to the extent necessary for its use in accordance with the contract and for data backup purposes.
- Actions that are expressly permitted by law remain unaffected.
- Copyright notices, license notices, and technical protection measures may not be removed, altered, or circumvented without authorization.
§ 7 License Activation and License Verification
- You may need to enter a valid license key to activate and use paid features.
- To check the license status, LinkYourShop can connect to Freemius's license servers.
- In particular, license keys, domain names, activation status, software versions, and other technical information required for license and update management may be processed.
- The customer may not circumvent or tamper with technical measures designed to verify the license or limit the number of permitted website activations.
- You can change the activated domain through the license management system provided by Freemius, provided that the purchased license model and the technical requirements allow it.
§ 8 Provision, Download, and Installation
- The software will be made available to the customer electronically for download or via another feature provided by Freemius following a successful purchase or the setup of a trial license.
- The customer is generally responsible for the installation, setup, and ongoing backup of their WordPress website.
- The manufacturer is only obligated to perform installation or custom setup if this has been expressly agreed upon in addition to the standard terms.
- The documentation and instructions on the product website are intended to assist you with installation and operation.
§ 9 Updates
- While the customer has an active paid license, they will receive the software updates provided for their license model.
- Updates may include bug fixes, security enhancements, adjustments to WordPress or external platforms, and functional changes.
- The manufacturer is entitled to further develop the software and to modify user interfaces, technical processes, or individual functions, provided that such modifications do not unreasonably impair the software’s usability as specified in the contract.
- The customer is responsible for creating a complete backup of their website and database before performing an update.
- Statutory obligations to provide updates to consumers remain unaffected.
§ 10 Support
- During the term of an active Starter or Pro license, the customer receives support to the extent described on the product website.
- Support generally includes assistance with questions regarding the installation, activation, and proper use of LinkYourShop.
- In particular, the following are not included:
- general WordPress, hosting, or server tasks,
- Modifications to third-party themes or plugins,
- Custom programming services,
- Errors caused by outdated or incompatible third-party software,
- Working on Etsy accounts or other external platforms,
- Recovery of unsaved data.
- The manufacturer may request the technical information necessary to process a support request, as well as a clear description of the problem.
- Unless a specific response time has been expressly agreed upon, there is no entitlement to have the matter processed within a fixed time frame.
§ 11 Customer Obligations
- The customer is required to,
- to use the software only within the scope of the purchased license,
- Protect login credentials and license keys from unauthorized access,
- to create backup copies before imports, updates, and major changes,
- to comply with the technical requirements,
- to use only such content and product data that he is authorized to use.
- The customer is solely responsible for the legality of the product data, images, text, prices, and external links that they import and publish.
- The customer is also responsible for ensuring that its own product catalog and website comply with legal requirements, particularly with regard to the legal notice, privacy policy, pricing information, advertising, and any labeling requirements.
- LinkYourShop is not a substitute for legal, tax, or business advice.
§ 12 External Platforms and Third-Party Providers
- LinkYourShop can use or interact with the features and data formats of external services.
- The use of external platforms is also subject to their own terms and conditions and privacy policies.
- The manufacturer has no control over availability, technical changes, service suspensions, data formats, or the terms and conditions of external platforms.
- We cannot guarantee long-term compatibility with a third-party provider's export format or feature set if it remains unchanged.
- The manufacturer will make every reasonable effort, within the limits of what is economically and technically feasible, to adapt LinkYourShop to relevant changes in supported platforms.
§ 13 Consequences of Termination and License Expiration
- Upon the expiration or termination of a license, any rights to further updates and support shall cease, unless otherwise required by law.
- Product data and settings that have already been imported are not automatically deleted simply because a license has expired.
- Which features remain available after a license expires depends on the respective product description and the technical specifications of the license.
- After the license expires, the manufacturer may restrict functions that require an active license, including, in particular, new imports, updates, license activations, or access to updates.
- The customer's statutory rights upon termination of the contract remain unaffected.
§ 14 Rights in the Event of Defects
- The statutory provisions regarding liability for defects in digital products apply.
- The customer is asked to describe any errors that occur as precisely as possible and to provide the manufacturer with the information necessary for investigation.
- In particular, a defect does not exist solely because the software does not work with an unsupported or significantly outdated WordPress, PHP, theme, plugin, or server configuration.
- In addition, the statutory obligations to inspect and report defects apply to business owners, to the extent that they are applicable.
- These terms and conditions do not limit consumers' statutory rights.
§ 15 Liability
- The manufacturer has unlimited liability:
- in cases of willful misconduct and gross negligence,
- in the case of damages resulting from injury to life, body, or health,
- in the event of fraudulent concealment of a defect,
- to the extent of an expressly assumed warranty, as well as
- to the extent that liability exists under mandatory statutory provisions.
- In the event of a breach of a material contractual obligation due to slight negligence, the manufacturer is liable only for compensation for foreseeable damages typical for this type of contract. Material contractual obligations are those whose fulfillment is essential for the proper performance of the contract and on whose compliance the customer may reasonably rely.
- With respect to business customers, liability under paragraph 2 is further limited to the amount that the customer paid for the affected license during the twelve months preceding the occurrence of the event giving rise to the damage.
- Furthermore, liability for damages caused by slight negligence is excluded to the extent permitted by law.
- The manufacturer shall not be liable for malfunctions, failures, data loss, or other damages to the extent that these are not attributable to the manufacturer and are caused, in particular, by:
- Outages or misconfigurations of the hosting service or server,
- unsupported or outdated versions of WordPress, PHP, or the server,
- incompatible, defective, or modified themes, plugins, or other third-party software,
- program code developed in-house or provided by third parties,
- Changes, restrictions, or outages affecting external services and platforms, particularly Etsy or Freemius,
- incorrect operation or use contrary to the documentation,
- unauthorized access by third parties, malware, or security vulnerabilities beyond the manufacturer's control,
- the customer's failure to perform reasonable data backups.
- The customer is required to create a complete and functional backup of their website and database prior to any installation, import, update, or significant change. To the extent that damage would have been avoided or mitigated had a proper data backup been performed, this must be taken into account when determining the extent of the damage in accordance with statutory provisions.
- The manufacturer does not guarantee that LinkYourShop will be available without interruption at all times or that it will be compatible with all themes, plugins, hosting environments, and future versions of external platforms. This does not apply if a specific compatibility or function has been expressly agreed upon as a warranted characteristic.
- The foregoing limitations of liability apply mutatis mutandis to the manufacturer’s legal representatives, employees, and agents.
- The customer's statutory rights regarding defects and mandatory claims remain unaffected.
§ 16 Changes to the Software and These Terms and Conditions
- The manufacturer may continue to enhance LinkYourShop both technically and functionally.
- Changes that go beyond necessary bug fixes, security updates, or compatibility adjustments and that significantly impair usability will be made only in accordance with legal requirements.
- Changes to these terms and conditions will be communicated to the customer in an appropriate manner, to the extent that they affect an existing contractual relationship.
- Legal requirements regarding changes to permanently made-available digital products remain unaffected.
§ 17 Data Protection
- Information regarding the processing of personal data by the manufacturer can be found in the privacy policy on the LinkYourShop website.
- Freemius processes personal data for payment, licensing, and subscription management in accordance with its own privacy policy.
- Additional information regarding the technical license verification within the plugin is provided in the Privacy Policy and, where applicable, directly within the plugin.
§ 18 Final Provisions
- The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
- With respect to consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the country in which the consumer has his or her habitual residence.
- If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction shall be the manufacturer’s registered office, to the extent permitted by law.
- If any provision of these Terms and Conditions is or becomes invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provisions.
